Updated October 14, 2026. This page now covers the measuring tools the site can run: visit counting, an advertising tag and session recording. They run only after you say yes, and never on a browser that sends a Global Privacy Control or Do Not Track signal. The changes are in sections 1, 2, 3, 6, 7 and 8.
The short version: we collect what you give us and basic site analytics, we use it to respond to you and run our business, we never sell it, and you can ask us what we have or ask us to delete it by emailing support@marqueandheir.com. If you say yes when one of our tools asks, the measuring tools in section 6 also run on your browser: visit counting, an advertising tag and session recording. Say no, or send a Global Privacy Control or Do Not Track signal, and none of them load. Your mobile number and text-message consent are never shared with anyone else for marketing.
1. What we collect
- You give us: name, phone, email, business name, and anything you put in a form, email, or text to us.
- Collected automatically: basic visit facts recorded by our own systems (the page visited, phone or desktop, the referring site, and a referral code if you arrived from a referral link), plus the approximate location our host derives from an IP address. Browser storage is separate and described in section 6 — the interactive tools ask before keeping anything.
- Only if you say yes when a tool asks: the measuring tools in section 6 receive the pages you visit and the first page of your visit, the name of a form you send (never what you typed in it), a press on one of our phone numbers and the page it was on, the referral code you arrived with, and, for session recording, a recording of how you moved through the page with what you type hidden, along with the basic facts any web request carries, such as your browser's internet address and type.
- If you text us or opt in to texts: your number and message history. Consent to receive texts is never a condition of purchase. Message frequency varies; message and data rates may apply; reply STOP to opt out (honored within 10 business days), HELP for help.
2. How we use it
To respond to inquiries, provide and improve services, send things you asked for, bill for work, and meet legal obligations. If we ever want to use your information for something else, we ask first. With your yes (section 6), we also count visits, record sessions to see where a page confuses people, and show our ads to browsers that visited.
3. What we share — and don't
We do not sell personal information. We do not intentionally request or collect sensitive personal information (health, government IDs, precise location, biometrics), and we would never sell sensitive information — with or without consent. Our forms have open text boxes, so if you choose to include sensitive information in a message, we don't use it for anything beyond answering you, and you can ask us to delete it at any time. We don't share your information for anyone else's marketing. We share it only with: service providers who help us operate (website hosting, CRM/communications platform, payment processing — each bound to use it only for our work), professional advisors, authorities if the law requires, and, only after you say yes (section 6), our analytics service, our session-recording service (Microsoft Clarity) and the advertising platform we use (Meta), which receives a signal that a browser visited our site, sent one of our forms or pressed one of our phone numbers, so we can show that browser an ad later. Meta does not receive your name, number, email or anything you typed into a form.
Text messages. We do not share, sell, rent or transfer your mobile number or your text-message opt-in to anyone for their marketing or promotional use. Text-message opt-in data and consent are excluded from every kind of sharing listed above, and we will not share them with any third party. The only company that handles your number for texting is the phone company we use to send and receive our texts, and it does so only to carry our messages to you.
4. Client campaign data
When we run marketing for a business client, the leads, calls, and customer information generated belong to that client; we process them only to deliver the client's services under our agreement with them.
5. Testimonials and client stories
We publish client names, quotes, logos, project photos, and results only with that client's written permission first — we ask, we show them exactly what will appear, and we don't post until they say yes. If a client later asks us to take their testimonial down, we take it down. We don't publish a client's numbers, contract terms, or what they pay us unless they've specifically approved that too.
6. Cookies, analytics, and your browser's privacy signals
You can block cookies in your browser; the site still works. What we use, and why:
| Category | What it does | Do we use it? |
|---|---|---|
| Strictly necessary | Makes pages load, keeps forms working, basic security | Yes — the site can't run without these |
| Browser storage for the interactive tools | Keeps what you do in a tool — a demo you tried, a job-application draft — in your own browser, so it is still there when you come back. Never sent to us. | Only if you say yes. A tool asks the first time you use it, your answer is saved either way, and you can change it below. |
| Analytics | Counts visits and shows which pages get read; also counts a form sent (by its name, never what you typed), a press on one of our phone numbers (by its page) and the referral code you arrived with | Only if you say yes. The same question a tool asks before it keeps your work also asks this. One service at a time — Plausible, Umami, Cloudflare Web Analytics (visit counts only) or Google Analytics 4 with its advertising features off — and some of them set their own cookies. We honor Global Privacy Control and Do Not Track as a no. |
| Advertising / retargeting | Lets Meta show you a Marque & Heir ad later, on its platforms | Only if you say yes. The same question a tool asks before it keeps your work also asks this; your answer covers the whole site until you change it below. We honor Global Privacy Control as a no. Do Not Track counts as a no as well. |
| Session recording and heatmaps | Records how a visit moves through a page (scrolls, clicks and taps) and maps where people click and how far they scroll, so we can see where a page confuses people; each recording is marked with the referral code and the first page of the visit | Only if you say yes, through the same question. Microsoft Clarity, set to hide what you type. We honor Global Privacy Control and Do Not Track as a no. |
| Sale of data / data brokers | Passing your information to others for their own use | No. Never. |
Browser storage, in plain words
There is no site-wide storage banner on this site. The tools that can keep your work ask you at the tool, the first time you use one, and your answer covers the whole site until you change it. The same answer turns the measuring tools in the table above on or off; a change to no takes effect from the next page you open.
- Always on, because the site can't work without it: the store's cart and order hand-off while you buy; the referral code from a referral link, kept 90 days so the person who sent you gets credit; a random id for the length of your visit so your visit and anything you send us line up; and your storage answer itself.
- The mh_lang cookie remembers your language choice as en or es for one year. It is set only when you choose a language or when the site opens in the language your browser asks for. Unlike the settings kept only on your device, it travels with each page request so the site can open the page in that language.
- Only if you say yes at the tool: tool-demo memory (searches you ran, slots you held, picks you pressed) and the job-application draft on the hiring page. The same yes lets the measuring tools in the table above load on your browser, and they may keep their own cookies or browser storage.
- Set by you, kept on your device: the reading settings on blog posts, and the remembered name on the team sign-in door. These stay in your browser and are never sent to us.
- The mh_bubble_spot setting remembers which side of the screen and how far down you left the Front desk button. It is kept only when you move that button and is cleared when you send it back to its corner with a double tap or a long press. It stays in this browser and is never sent to us.
Your storage and measuring choice on this device
Your browser's privacy signals (Global Privacy Control, Do Not Track). Universal opt-out signals like Global Privacy Control exist to tell a site not to sell your data or use it for targeted advertising. We never sell your data. We do use advertising tags for retargeting when section 6 says they are on, and we treat a GPC or DNT signal from your browser as a valid opt-out from that, on that browser, automatically. The same signal also keeps our analytics service and our session recording off on that browser.
7. Keeping and protecting it
We keep personal information only as long as needed for the purposes above or as law requires, and we protect it with access controls, encrypted storage, and least-privilege practices.
Advertising audiences we build from site visits are kept no longer than 90 days from the visit. A browser that sends us a form request is removed from the "did not enquire" audience within seven days. A browser that says no sends nothing more from the next page it opens and drops out of those audiences when its 90 days run out, and a browser that sends a Global Privacy Control or Do Not Track signal is not added while it sends one. Analytics counts and session recordings are kept by those services for the period each one sets; where a service lets us choose, we choose the shortest it offers.
Text-message records — your opt-in, any opt-out, and the texts between us — we keep for six years from the last message or the end of our work together, whichever is later, and longer only while a dispute or legal hold is open.
8. Your choices
Email us to ask what we hold about you, correct it, or delete it (we'll comply unless law or an active engagement requires otherwise). Texas residents: the Texas Data Privacy and Security Act provides rights that may apply depending on business thresholds; we honor reasonable requests regardless of threshold. Your storage and measuring choice for this site lives in section 6 above.
If you ask us to delete your information, we still keep the record that you opted out of texts or emails, and nothing else about you, so that we never contact you again by mistake.
9. Not for kids
Our services are for businesses; we don't knowingly collect information from anyone under 18, and our site isn't directed to children. We don't knowingly collect personal information from children under 13. If we learn that we've received information from a child under 13, we delete it. A parent or guardian who believes their child sent us information can email us at support@marqueandheir.com and we'll delete it.
10. Changes
We'll post updates here with a new effective date; material changes get a notice on the site.
